How do I get my criminal record cleared?

Under Illinois law, you can have your criminal record cleared by either having it sealed or expunged. See our previous posts to learn about the difference between these two options and which one you may qualify for.

Once you've determined your eligibility for sealing or expungement, you may be wondering how to proceed next. We've mapped out the process of clearing your record in three simple steps:

1. Obtain copies of your criminal records.

You will need the following records:

· Chicago RAP (Record of Arrests and Prosecutions) Sheet-available from the Chicago Police Department

· Court Disposition-available from the Circuit Clerk. Note: For Cook County, court records are not available online, so you will need to request these in person.

· Statewide Criminal History Transcript-available through the Illinois State Police, any law enforcement agency or any LiveScan vendor

2. Complete the necessary forms.

To request that one case be cleared from your record, you will need to submit the following forms:

· Request to Expunge & Impound and/or Seal Criminal Records

· Notice of Filing for Expungement and/or Sealing

If you are requesting that more than one item be cleared from your record, you may also need to submit these forms:

· Additional Arrests or Cases or Expungement

· Additional Notice of Filing for Expungement and/or Sealing (use only if you have arrests from multiple agencies)

3. File your forms.

You must submit your request in the same county in which you were arrested. You will need to file your forms with the Circuit Clerk's office. You can always file in person, but some counties also permit you to file online or by mail. Contact the Circuit Clerk in your county to find out the submission options, required fees and allowable payment methods. If you are unable to pay the necessary fees, you can file an Application for Waiver of Court Fees.
