Why you should have an attorney after a DUI arrest

As we write this post, we hope our readers have enjoyed the “Halloween” season of costume themed parties and events. We also hope that our posts have been compelling, unique and genuinely informative.

The unfortunate reality is that some people will stumble upon our blog because someone they know or love has been arrested for drunk driving. If that’s the case, it is important to have an attorney by their side to advise them of their rights and options. Most people believe that lawyers are just dispensable agents who are not very useful in times of crisis, but the following are two important reasons to have legal counsel.

Telling your side of the story - You may not realize it all, but all the accounts written in police reports are simply one side of the story, and they don’t necessarily represent your recollection of what occurred. This is not to say that police lie in their reports (even though it has been done before) but there may be subtle differences that are missed (or ignored) that may exonerate you. A skilled attorney can find the nuances in a story and root out facts that can help you in court.

The U.S. Constitution – Simply put, you have a right to an attorney if you are charged with a crime. This right (along with the right to remain silent) is a bedrock principle of our justice system and is central to the notion of innocence until proven guilty. It is also critical for those people who are scared, intimidated and unable to speak for themselves in the face of criminal accusations.

If you have questions about your rights and options after a DUI arrest, an experienced attorney can help.
