ATF Initiative Leads to 41 Arrests in Two-Months
Recently, the United States Attorney’s Office for the Northern District of Illinois announced the results of a two-month “enhanced enforcement initiative” targeting firearm and machinegun conversion devices in the Chicagoland area that led to charges against 41 individuals and recovery of approximately 171 firearms and 64 machinegun conversion devices. A machinegun conversion device, also known as a “machine gun conversion kit,” is a mechanism or part designed to convert a semiautomatic firearm into a fully automatic firearm which have proliferated in recent years, with a 784% increase nationwide in the number of suspected machinegun conversion devices recovered by law enforcement nationwide from 2019 to 2023. “Machinegun conversion devices are increasingly being used by criminals, putting both innocent civilians and law enforcement in danger,” said ATF Special Agent in Charge Christopher Amon. “This operation aggressively targeted offenders suspected of trafficking illegal machinegun conversion devices into our communities.” As a result of the deadly consequences that allow firearms the ability to fire rounds rapidly with these devices equipped, the penalties allowed under the law for those who are charged with possessing such devices increase greatly.
State and Federal Authorities Prioritizing Enforcement Against Machinegun Devices
As we previously covered, law enforcement views these devices as an increasing problem and the aforementioned ATF initiative utilized both State and Federal resources as part of this law enforcement crackdown. Illinois Attorney General Kwame Raoul applauded the joint effort, saying “State-federal partnerships, such as with the ATF, are essential to my office’s work to prevent illegal firearms from entering communities, hold gun traffickers accountable and address other gun crime cases. Collaborations and resource sharing between all levels of law enforcement – local, state and federal – are vital in our work to prevent gun violence in Illinois.” Almost immediately upon taking office in December 2024, Cook County State’s Attorney Eileen O’Neill Burke directed her office to seek prison sentences in every felony case involving machine gun-type weapons cases, including those that involved the devices that effectively converted semiautomatic firearms into machine guns. In announcing the policy shift, Yvette Loizon, chief of policy at the state’s attorney’s office, acknowledged that the new policy would likely result in prolonged felony cases and that the office would likely, “have to put more effort into these cases and take them to trial” the seriousness of the cases and their potential deadly consequences demanded such action in the face of the rising threat they posed. Clearly, given the Federal and State prosecutors respective increased efforts to prosecute these cases, anyone who is caught and charged with what law enforcement believes to be a machinegun conversion switch will be facing an uphill battle and potentially face lengthy prison sentences over their alleged conduct as prosecutors in both offices seek to deter the proliferation of these devices readily available on the black market.
